These terms and conditions (“Terms”) govern your use of the Molecular Imaging Systems Store (“MIS Store”). By placing an order through the MIS Store, you agree that you are bound by these Terms, in addition to the Site Terms and Site Privacy Policy. If you are unwilling to be bound by these Terms and the Site Terms, you may not use the MIS Store.

Registration, User ID's and Passwords

You must register with the MIS Store by providing information requested on the registration page. You must keep your User ID and Password secret. You are responsible for all transactions on the MIS Store that are made with your User ID and Password.

Order Validation and Acceptance

When you place an order online through the MIS Store, we may verify your method of payment, shipping address and/or tax exempt identification number, if any, before processing your order. Your placement of an order via the MIS Store is an offer to purchase our products or services. We may accept your order by processing your payment and shipping the product, or may, for any reason, decline to accept your order or any part of your order. Orders will be deemed accepted by us only when the product has been shipped.

Quantity Limitations

We may limit or cancel quantities available for purchase on any order for any reason. We may alter the availability or duration of any special offers at any time.

Electronic Communication

When you place an order through the MIS Store, you are required to provide a valid e-mail address, which we may use to communicate with you regarding the status of your order, advise you regarding shipment of backordered products, and to provide you with any other notices, disclosures or other communications relating to your order. You agree that we will not be responsible for any damage you incur, or information you do not receive, as a result of your failure to provide a valid e-mail address.

Pricing and Product Information

We make every effort to provide current and accurate information relating to our products but do not guarantee the currency or accuracy of any such information. Information relating to our products is subject to change without notice. Prices are subject to change at any time prior to our acceptance of your order. In the event we discover a material error in the description or availability of a product that affects your outstanding order, or an error in pricing, we will notify you of the corrected version, and you may choose to accept the corrected version, or cancel the order. If you choose to cancel the order and your credit card has already been charged for a purchase we will issue a credit to your credit card in the amount of the charge.

Security and Privacy

The MIS Store follows the industry standard, Secure Sockets Layer protocol, "SSL," for the transfer of data over the internet. When placing an order online, a "key-lock" icon will appear in the bottom right of your browser window. This icon is your confirmation that SSL has been activated for the transfer of your personal information. A second indication of SSL activation is that the displayed URL will begin with "https".

Payment and Shipment

You may pay for your order with one of the following major credit cards, issued in the United States of America: Visa®, MasterCard®, and American Express® cards. Most items ship within 3 business days of receipt of order. In order to deliver the highest quality product, items requiring special shipping conditions (such as temperature control, etc.) will not be shipped on Fridays or prior to any US holidays. International orders requiring special shipping conditions will not be shipped on Thursday, Fridays, or 2 days prior to any US holidays. In the event your shipment will be delayed more than 30 days after the date of your order, we will attempt to notify you by e-mail, using the e-mail address you provided, and you may elect to cancel the order. If you elect to cancel the order, we will issue a refund.

You must inspect arriving shipments and report errors in shipment to your carrier, and file claims for damage with your carrier, promptly upon shipment arrival. You must report concealed damage or shortages involving shipments received intact to us within ten business days after receipt.

Sales Tax

We collect and remit sales taxes as required by law on purchases made through the MIS Store. If you have tax-exempt status, you must provide a valid tax exemption number evidencing your status and a copy of the certification at the time of purchase. We will not refund tax amounts collected if you did not provide a valid number when requested. If you provide a number that is not accepted for any reason by any governmental or regulatory authority, and we are required to pay tax on your purchase, you agree that you will reimburse us for the amount of such tax and our reasonable expenses incurred in connection with the payment and collection of such tax, and you authorize us to charge the credit card you used for the original transaction for the amount of the sales taxes owed.

Disclaimer and Restriction of Use

It is understood that these products are for research only. They are not intended to be used for, nor are they to be used for, diagnostic purposes or for other uses regulated by the US Food and Drug Administration or other government entities having similar regulatory programs and powers. We have no responsibility to provide any warnings or safety, instructional or other information concerning the products.

Warranty and Limitation of Liability for Products

We warrants that the products sold subject to these Terms shall be free from defects in workmanship and material under normal use and service for a period of 6 month from the date of delivery. We must receive any warranty claim within 30 days of you becoming aware of any such defect. Our sole obligation under this warranty is to, at our option, refund the purchase price of the product or replace said product. In no event shall we be liable for incidental and/or consequential damages, including the cost of cover. All warranties are extended to original end user purchaser only. WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Return Policy

Authorization for all product returns must be approved by our Technical Services Department and a return authorization number given to you prior to the return of goods. Not all items will be authorized for return, due to temperature and packing requirements. Items authorized for return must arrive at our facilities in a state satisfactory for resale to be eligible for product credit. A restocking charge of 15% shall be charged on returns that are not the result of any error or fault of ours. Shipping charges will not be credited. Goods may not be returned for credit after 30 days after your receipt of the goods.

Note: You must ship insured and prepaid. Refunds won't be made for products that are lost or damaged during shipping. After we receive your returned product, a credit will be issued to the credit card account used to make the purchase. We reserve the right to make the determination of undamaged condition and may reduce your credit if the product is damaged or if all the original package contents aren't returned.

Returning products that were part of a special promotion:
The MIS store may occasionally offer promotional pricing on products that is dependent on certain terms of purchase. If you return a product for which you received special promotional discounts, you will receive a credit for that product's return that will not exceed the promotional pricing you received at the time of purchase. If as a part of a promotion you received a second product at no cost or at a reduced price when another product was purchased, credit for the return of the first product will be reduced to factor in the savings on the second product if the second product is not returned with the first product. If all products are returned, the full purchase price will be credited.
